You were out with your friends having a good time. You were in the process of driving home and all of a sudden you saw police lights in your rear view mirror. You had to pull over. The police officer first asks to see your drivers license and proof of insurance. But it seems like the next question the police officer always asks you is if you have been drinking or if you have taken any drugs. If you say “yes”, or, if the police officer claims to smell alcohol or claims to smell the odor of marijuana (pot), the police officer will ask you to step out of your car and have you do some Field Sobriety Tests. You think that you did fine on these tests. The police officer never said that you failed any of the tests. When the tests were done, the next thing you know the police officer tells you that you are being arrested and charged for Driving While Under the Influence of Alcohol and/or Drugs (DUI). You are thinking to yourself, “What is going on? This can’t be happening to me!”You were taken down to the police station and then the police officer read to you the Implied Consent Law and asked you if you would submit to a chemical test of your breath or blood. You were told that if you refused to take the test, your drivers license would be immediately revoked for a period of one year. You may have agreed to this chemical test of your breath or blood or you refused to blow.
At some point in time the police officer read to you your Miranda Rights (The right to remain silent; that anything you say can and will be used against you in a court of law; that you have the right to talk to a lawyer). If you agreed to talk to the police, the officer asked you several questions, such as do you know what time it is? What is the date? When did you last eat? Were you operating the vehicle at the time of the stop? Have you been drinking? How much? Are you under the influence of an alcoholic beverage? Have you taken any drugs? What kind of drugs?
When you are released, the police officer gives you a DUI ticket, and a white piece of paper and tells you that your drivers license is going to be suspended in 15 days as a result of the DOR Administrative Hearing Process.
You maybe wondering what is the difference between the DUI Ticket and the DOR Administrative Hearing Process? Does this mean there are two (2) ways to lose your drivers license? (Yes it does.) You can’t have your drivers license suspended! You need to be able to drive! Then you start to wonder if you are going to have to put an Ignition Interlock Device on your car? Are you going to have to wear a SCRAM device on your ankle? Are you going to have to miss work to go to all your Court dates? Are you going to end up spending time in jail? What do you do now?
