You have been out riding your motorcycle. You have been riding out on one of the many motorcycle scenic drives in the State of Missouri, such as Highway 21, Highway 67, Highway 94, Highway 79, or crossed over into Illinois and went down the Mississippi River Road. The police officer gives you a ticket, or several tickets, for something like Speeding, Improper Lane Use, Failure to Signal, Careless and Imprudent, etc. etc. Then the police officer says he smells alcohol, and then asks or tells you to perform some Field Sobriety Tests, such as the Horizontal Gaze Nystagmus Test (HGN), Walk and Turn Test (WAT) and the One Leg Stand Test (OLS). The police officer may also have asked you to blow into a Preliminary Breath Test (PBT). The next thing you know you are being arrested for DWI (Driving While Intoxicated) or DUI (Driving Under the Influence).Maybe there has been a Motorcycle Accident. A car forced you off the road or pulled out in front of you or you failed to navigate a turn correctly. The police always suspect that if there has been a crash, the motorcycle operator was impaired by alcohol and or drugs. Instead of asking how did the accident happen, the police officer asks the motorcyclist, who probably shaken, dazed and injured, “how much did you have to drink?”
The police officer handcuffs you and takes you to the station. When you are released, the police officer gives you a DWI ticket, and a white piece of paper and tells you that your drivers license is going to be suspended in 15 days as a result of the DOR Administrative Alcohol Hearing Process.
You maybe wondering what is the difference between the DWI Ticket and the DOR Administrative Alcohol Hearing Process? Does this mean there are two (2) ways to lose your drivers license? (Yes it does.) You can’t have your drivers license suspended! You need to be able to drive! Then you start to wonder if you are going to have to put an Ignition Interlock Device on your car?
